Service and Payment: - I have the right to decline a request or commission from anyone for any reason. - I have the right to cancel a request or commission made by someone for any reason. (Note: I do refunds depending on how much progress I got done. I will present evidence.) - All payment must be paid before I will start on the commissioner’s order. (Unless the payment is mall sim currency or art. Note: if you're a mutual or have a good reputation, I might allow you to pay when the comm's sketch is done instead. I will present evidence.) - People on my DNI/Blacklist cannot order a commission from me. - By commissioning me, you agree to my Terms of Service. - By owning any of my designs, you agree to my Terms of Service. - Codeword not required unless the project rules says so. - It is preferred that you have a TH account when buying a design made by me from me but it is not required. I can provide a TH code, if needed. Please do not request a TH code in any of my sales projects (adopts, comms, etc.) - If you don't have a TH account, please make a separate project to store the character if you have bought one of my designs and make sure you send the link to me. Refunds (only applies to dA pts): -Art commissions may get a partial refund (to the nearest whole number if it ends up being a decimal) if the commissioner cancels the order. How much commissioners are refunded is based on how much of the commission was done before it got canceled. Once the final stage of the commission is done, the commissioner cannot cancel their order. For example, if the commission is supposed to be shaded, once the shading stage is done, it can no longer be refunded. (Disclaimer: Commissions that only have the sketch and lineart stages cannot be refunded.) a. Sketch: 90% b. Lineart: 70% c. Colored: 30% -Custom commissions may get a 25% refund if the commissioner returns the design within 1 week of receiving it. If the payment can’t be split into quarters, the refund will be 25% to the nearest whole number (e.g. 25% of 10 is 2.5 so it will be rounded to the nearest whole number of 3). When the design is returned to me, I have the right to resell it as an adoptable or give it away. This does NOT apply to premade designs/adoptables. Crediting: -Keep my signature on the image of the design or artwork. -If posting on-site, credit me with on Scratch or with a direct link to my profile: . -If posting off-site, credit me with https://toyhou.se/SnailishWeather or SnailWeather on Toyhou.se instead. If posting on TH, directly credit me on site with SnailWeather. - (Only applies to adoptables or customs:) Give credit to the base artist if I used a base to make the design. - Please do not write things like "credit to designer" or "all credits to original" when using my design and art. That's not actually the same as crediting. Please @ me or link my profile directly as stated in the 2nd-3rd bullet of this section. ~Custom/Adoptable Specific Rules~ Usage of Design: - My designs cannot be used for content involving anything inappropriate for minors. - My design cannot be used to promote offensive content which includes sexism, racism, ableism, and any other sort of prejudice. ᴄᴡ: ᴄʜᴏᴄᴏʟᴀᴛᴇ - My designs cannot be used to go against the guidelines or rules of any other site. - My designs cannot be used to create Non-Fungible Tokens (NFTs). - Any commercial use of my designs must first be discussed with me. Renaming and Redesigning: - Adding or removing anything from the design’s original description is allowed. (Note: This is not required but if the design happens to originally be LGBTQ+, I would prefer the owner to keep them that way.) - Please do not change the original body type of my designs. - Redesigning or designing another species form of them is allowed as long as the design is still recognizable. This includes Make Your Own (MYO) species but only if the species’ Terms of Service allows you too. - Nobody can recolor, trace, or take credit for the original image of the design! Gifting, Trading, and Reselling: - Do NOT give any of my designs to people on my blacklist (or at least, try not to. If you do so by accident, I won't hold that against you.) - It is preferred that you inform me before gifting, trading, or reselling one of my designs that you own. - The design can be resold, gifted, or traded if the owner has owned the design for more than a week. - If reselling, the design must be resold for the price they were initially bought with (unless worth was added with paid art or personal art). **If you break my TOS, I reserve the right to take back any of my designs from you!!** Feel free to ask questions in the comments or on my profile! ^-^
While being reworked, this TOS still applies. Please use full codeword and not just the letters separately. If you don't credit me or "don't feel like crediting" me, you will potentially be put on my greylist. I find it pretty rude to not credit the designers though, especially if you're reselling/rehoming characters. Blacklist/People I'm not comfortable owning my designs (Please do not bother these people. Just report them unless you don’t agree with my reason.): @FunArt_3 - uses AI to make designs @Goldensun_silverdrop - [personal] Note: You may use my Terms of Service as a general guide to make your own but please only add rules I have written if you genuinely and honestly do want them applied to your own designs/art. Same goes with my drawing preferences chart. It is preferred that you don't copy me word-for-word since that is basically stealing. (This is only here because this happened before and it made me uncomfortable.)
